Services: Game server hosting (Minecraft, ARK, FiveM, etc.), add-ons, mods, management tools, and related services.
Client / User: The individual or entity purchasing Services from TheGameHosting.
Account: The customer’s account within TheGameHosting’s control panel or billing system.
Initial Payment: The first payment made when purchasing a new service.
Renewals / Future Payments: Payments for ongoing service periods (monthly, quarterly, yearly, or otherwise).
2.1 By creating an account and using our Services, you confirm that you are of legal age and have the authority to enter into this Agreement.
2.2 TheGameHosting reserves the right to modify these ToS at any time. Changes will become effective once published on our website. Continued use of the Services constitutes acceptance of the updated terms.
The Client agrees not to use our Services for unlawful or abusive activities, including but not limited to:
– Copyright infringement, distribution of pirated content, or violation of intellectual property rights.
– Hacking, DDoS attacks, spam, phishing, or malicious activities.
– Hosting illegal, defamatory, obscene, or offensive content.
– Activities that interfere with other users or TheGameHosting’s infrastructure.
TheGameHosting reserves the right to suspend or terminate Services violating the AUP without refund.
4.1 All fees must be paid in full before Services are provided.
4.2 Renewal payments are due at the end of each service period unless canceled by the Client beforehand.
4.3 Failure to pay within the grace period (e.g., 7 days after due date) may result in suspension or termination.
4.4 Clients are responsible for canceling any external automatic payment methods (e.g., PayPal subscriptions).
5.1 Initial Payment Refunds
– Refunds are available only within the first 24 hours after the initial payment.
– A support ticket must be submitted within this timeframe requesting the refund.
– Refunds apply only to the initial payment and not to any renewals.
– If the service has already been used (server activated, resources deployed, etc.), TheGameHosting may refuse or partially grant the refund at its sole discretion.
5.2 Renewals and Future Payments
– No refunds will be issued for renewal payments or any subsequent billing cycles.
– Clients must cancel before the next billing date to avoid renewal charges.
5.3 Account Credit / Balance
– No refunds are provided for any account credit or balance held in a Client’s account.
– Account credit may only be used for future Services within TheGameHosting.
5.4 General No-Refund Policy
Except for the initial 24-hour refund window described above, TheGameHosting does not provide refunds of any kind.
5.5 Service Cancellation
– Service cancellation does not entitle the Client to a refund unless eligible under Section 5.1.
– Canceled services may remain active until the end of the paid term at TheGameHosting’s discretion.
6.1 TheGameHosting may suspend or terminate Services if the Client:
– Violates these ToS or the AUP.
– Fails to make payment after the grace period.
– Uses Services for illegal or abusive purposes.
6.2 In cases of termination due to Client violation, no refunds will be issued.
7.1 TheGameHosting does not guarantee uninterrupted, error-free, or completely secure Services.
7.2 TheGameHosting is not liable for indirect, incidental, or consequential damages (loss of revenue, data, reputation, etc.).
7.3 The maximum liability of TheGameHosting shall not exceed the amount paid by the Client for the specific service in question.
All software, systems, control panels, logos, and trademarks of TheGameHosting remain the exclusive property of TheGameHosting or its licensors. The Client is granted only a limited right to use the Services for the contracted term.
TheGameHosting is committed to protecting Client data in accordance with our Privacy Policy. Data handling will comply with applicable laws.
We may modify, suspend, or discontinue features, plans, or pricing with prior notice. Such changes are not grounds for refunds unless specifically stated.
11.1 Disputes will first be addressed through direct negotiation or mediation before resorting to legal action.
If any provision of these ToS is found unenforceable, the remaining provisions will remain in full effect.
For support, cancellation, or refund requests (within 24 hours of the initial payment), Clients must contact TheGameHosting via ticket.
